Welcome to iteksurvey. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Member") and Datadek Inc ("iteksurvey," "we," "us," or "our") governing your access to and use of the iteksurvey website, mobile applications, survey platform, reward programs, and all related services (collectively, the "Platform"). Please read these Terms carefully before creating an account or using any part of the Platform. By registering for an account, accessing the Platform, or participating in any survey or research activity, you affirm that you have read, understood, and unconditionally agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
By creating an account, accessing, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and all other policies, guidelines, and rules incorporated by reference, including our Privacy Policy and any reward program terms. If you do not agree to all of these Terms, you must not access or use the Platform. These Terms apply to all visitors, registered members, survey participants, and others who access the Platform. We reserve the right, in our sole discretion, to modify or replace these Terms at any time in accordance with Section 11 below. The version of these Terms in effect at the time of any particular use of the Platform governs that use. Your continued use of the Platform following notice of any changes constitutes your acceptance of the revised Terms.
To register for an account and use the Platform, you must: (a) be at least 16 years of age, or the age of digital consent in your jurisdiction, whichever is higher; (b) be a natural person (corporations, organizations, and automated systems are not eligible); (c) reside in one of the countries currently supported by the Platform; and (d) not be previously suspended or banned from the Platform. By registering, you represent and warrant that all information you provide during registration and throughout your use of the Platform — including your name, email address, date of birth, country of residence, demographic data, and all survey responses — is truthful, accurate, current, and complete. You agree to maintain and promptly update your account information to keep it accurate. We reserve the right to verify your identity and the accuracy of your information at any time through email verification, identity document review, phone verification, or other means. One account per natural person is strictly permitted; the creation or use of multiple accounts by the same individual, whether using different email addresses or variations of personal information, is a material breach of these Terms.
You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any authentication factors used for two-factor authentication (if enabled). You accept full responsibility for all activities that occur under your account, whether authorized by you or not. You agree to: (a) use a strong, unique password for your iteksurvey account that you do not reuse on other services; (b) enable two-factor authentication when available; (c) log out from your account at the end of each session when using shared or public devices; (d) never share your account credentials with any other person; and (e) immediately notify us at support@iteksurvey.com if you become aware of any unauthorized access to or use of your account, or any other breach of security. We shall not be liable for any loss, damage, or liability arising from your failure to comply with this section or from unauthorized access to your account resulting from your negligence. We reserve the right to temporarily disable or lock accounts pending investigation of any suspected security breach.
As a member of iteksurvey, you agree to engage only in honest, thoughtful, and good-faith participation in all research activities. You agree that you will not, and will not encourage or assist any third party to: (a) provide false, misleading, fictitious, or deliberately inaccurate profile information or survey responses; (b) use any form of automation, bots, scripts, auto-clickers, or software agents to complete surveys, register accounts, or interact with the Platform; (c) use a virtual private network (VPN), proxy server, IP spoofing, or any other method to disguise or obfuscate your true geographic location or IP address; (d) attempt to complete the same survey or research activity more than once; (e) speed through surveys by providing random, nonsensical, or attention-failed (trap-failed) responses; (f) harass, threaten, abuse, defame, or otherwise violate the legal rights of other members, survey providers, or iteksurvey staff through Platform communications; (g) attempt to reverse engineer, decompile, or extract the source code of the Platform; or (h) use the Platform for any unlawful purpose or in violation of any applicable local, national, or international law. Violation of any provision in this section constitutes a material breach of these Terms and may result in immediate account termination, forfeiture of accrued rewards, and referral to law enforcement where appropriate.
Survey and research study opportunities are made available to members at iteksurvey's discretion based on your profile characteristics, demographic attributes, survey availability, and client targeting requirements. Participation in any particular survey is not guaranteed, and we make no representation that any minimum number of survey invitations will be extended to you. By entering a survey, you agree to: (a) complete the full survey unless exit is permitted by the survey design; (b) provide genuine, attentive, and well-considered responses throughout; (c) respond accurately to screening questions that determine your eligibility for specific research studies; and (d) respect the confidentiality of survey content by not disclosing, sharing, or reproducing survey questions, survey materials, product prototypes, or any confidential information revealed during research activities. We may employ quality assurance measures including attention-check questions (trap questions), completion-time monitoring, response-pattern analysis, consistency checks against your profile data, and open-ended response review. Failure to meet quality thresholds may result in partial or full forfeiture of the reward for that survey and, in cases of repeated or egregious quality failures, termination of your account. If you are screened out of a survey because your profile does not match the target demographic, you will not receive the full survey reward; however, where applicable, you may receive a nominal screening incentive at our discretion.
Rewards are calculated and credited to your member account upon successful and quality-verified completion of surveys and research activities. The reward amount for each opportunity is displayed before you begin. We reserve the right, in our sole discretion, to adjust reward amounts, to withhold or reverse rewards for responses that fail our quality review, and to modify the reward structure over time. You must accumulate a minimum balance (typically $10 USD or equivalent in your local currency) before you may initiate a withdrawal. Withdrawal methods may include PayPal, Amazon gift cards, Visa prepaid cards, bank transfers, and other redemption options as available in your country of residence; not all methods are available in all jurisdictions. We process withdrawals within the timeframes specified for each payment method (typically 1 to 10 business days), subject to ongoing fraud and compliance review. You are solely responsible for reporting and paying any taxes, duties, or levies that may be imposed on the rewards you earn through the Platform under the laws of your country of residence. We may require you to provide tax identification information where required by applicable law. We reserve the right to impose a dormancy fee or expire points after a reasonable period of account inactivity (typically 24 months), as detailed in our Rewards Policy. Rewards have no cash value outside the Platform and cannot be transferred, assigned, or sold to third parties.
The Platform and all content, features, and functionality thereof — including but not limited to the iteksurvey name, logo, trademarks, website design, user interface, software code, algorithms, text, graphics, images, and the selection and arrangement thereof — are and shall remain the exclusive property of Datadek Inc and its licensors, protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform solely for your personal, non-commercial participation in market research activities. You acquire no ownership rights in the Platform by virtue of your use. Regarding survey content: all survey questions, research materials, and study designs are owned by iteksurvey or the commissioning research client and are provided for your participation only; you may not copy, share, screenshot, or distribute them. Regarding your survey responses: when you participate in a survey, you assign and transfer to iteksurvey, and to the commissioning research client, all rights, title, and interest in and to your survey responses, including all intellectual property rights therein, for use in market research, analysis, product development, and related commercial purposes. This assignment is made in consideration of the rewards you receive. We grant a perpetual, irrevocable, worldwide, royalty-free license back to you to use your own de-identified survey responses for personal reference purposes only.
In addition to the Member Conduct requirements set forth in Section 4, the following activities are expressly prohibited on or in connection with the Platform and constitute a material breach of these Terms: (a) using any robot, spider, crawler, scraper, script, browser extension, or other automated means to access, extract data from, or interact with the Platform; (b) creating multiple accounts, whether using different email addresses, variations of your name, or other means; (c) sharing your account credentials with any other person or allowing another person to complete surveys on your behalf; (d) attempting to circumvent, disable, or interfere with any security features, authentication mechanisms, fraud detection systems, or quality control measures; (e) decompiling, reverse engineering, disassembling, or attempting to derive the source code, algorithms, or trade secrets of the Platform; (f) using the Platform to transmit viruses, malware, worms, Trojan horses, ransomware, or other malicious or harmful code; (g) engaging in any activity that imposes an unreasonable or disproportionately large load on our infrastructure through denial-of-service attacks, excessive API calls, or similar techniques; (h) using the Platform to violate any applicable laws, including those governing data privacy, anti-spam, export controls, and consumer protection; (i) impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity; or (j) encouraging or facilitating any third party to engage in any of the prohibited activities listed above. We reserve the right to investigate and take appropriate legal action and to cooperate with law enforcement authorities in prosecuting violations.
Termination by you: You may terminate your account at any time by navigating to your Profile Settings, selecting the Privacy & Security tab, and confirming the account deletion option. Upon termination by you, your right to access and use the Platform ceases immediately. Termination by us: We may, in our sole discretion and without prior notice, suspend, limit, or terminate your account and your access to the Platform if: (a) you breach any provision of these Terms; (b) we determine that your conduct may harm other members, research clients, or our legitimate business interests; (c) we are required to do so by law; or (d) we discontinue or materially modify the Platform or your region of service. In cases not involving egregious violations, we will provide reasonable notice by email and an opportunity to cure non-material breaches before termination. Effect of termination: Upon termination of your account for any reason, (i) your right to access and use the Platform immediately ceases; (ii) any rewards that have not yet met the minimum withdrawal threshold at the time of termination are forfeited, unless applicable law requires otherwise; (iii) you remain liable for any outstanding obligations, including any amounts owed to iteksurvey; and (iv) the provisions of these Terms that by their nature should survive termination shall continue in full force and effect, including Sections 7 (Intellectual Property), 8 (Prohibited Activities), 10 (Disclaimers and Liability), and 11 (Governing Law and Disputes). Data handling: Following termination, we will process your personal data in accordance with the data retention and deletion provisions set forth in our Privacy Policy.
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, iteksurvey expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement. We do not warrant that: (a) the Platform will function without interruption, errors, or defects; (b) any particular survey or reward opportunity will be available to you; (c) the Platform or our servers are free of viruses or harmful components; or (d) any errors or defects will be corrected. We are not responsible for any delays, delivery failures, or other damages resulting from events beyond our reasonable control, including acts of God, telecommunications failures, or governmental actions. To the maximum extent permitted by law, in no event shall iteksurvey, its affiliates, directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with: (i) your use or inability to use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) unauthorized access, use, or alteration of your transmissions or content; or (iv) any other matter relating to the Platform. In jurisdictions that do not allow the exclusion or limitation of certain warranties or liabilities, our liability shall be limited to the maximum extent permitted by law. In no event shall our aggregate liability to you for all claims arising from or relating to these Terms or the Platform exceed the total amount of rewards paid by us to you in the twelve months preceding the event giving rise to the claim, or $100 USD, whichever is greater.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms. For residents of the European Economic Area, United Kingdom, Switzerland, Australia, or any other jurisdiction where mandatory consumer protection laws confer jurisdiction in the courts of your country of residence, nothing in this section is intended to limit those rights. Dispute resolution: Before filing a formal legal claim, you agree to first contact us at legal@iteksurvey.com and attempt to resolve the dispute informally within 60 days. If informal resolution fails, any dispute arising from these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, unless you are a resident of a jurisdiction that prohibits mandatory arbitration of consumer disputes, in which case you may bring claims in your local courts. The arbitration shall take place in Natrona County, Wyoming, or, at your election, via video conference. Each party shall bear its own costs of arbitration, except that iteksurvey will pay the arbitration filing fee and arbitrator compensation for claims under $10,000 where you demonstrate financial hardship. Class action waiver: To the fullest extent permitted by applicable law, you and iteksurvey agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, collective, or representative action. You may not act as a plaintiff or class member in any purported class or representative proceeding. If this class action waiver is found to be unenforceable in whole or in part with respect to a particular claim, that claim shall be severed and litigated in court, while the remaining claims shall proceed in arbitration.
